This Agreement is a legal agreement between you, the end user, and Microelectronics and Computer Technology Corporation (MCC). If you do not agree to the terms of this Agreement, do not copy or install the Software on your computer and return the Software to your vendor for a full refund.
COPYRIGHT
The Software is owned by MCC and is protected by the copyright laws of the United States and other countries. Under this Agreement you may make one copy of the Software for archival purposes. Except for this right to make an archival copy of the Software, your right to use the Software is subject to the following License Grant.
LICENSE GRANT
You are permitted under this Agreement to use one copy of the Software on any single computer, provided that the Software is never in use on more than one computer at a time. If you have other copies of the Software, properly licensed from MCC, you may only use the Software on as many computers as you have licenses. If the number of users can exceed the number of such licenses you must insure that no more than the allowable number of copies of the Software are in use by those users at one time. You may not rent or lease the right to use the Software to anyone, but you may transfer your license right to the Software in connection with the sale or transfer of the Software to another.
LIMITED WARRANTY
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE USE OF THE SOFTWARE IS ASSUMED BY THE USER, AND MCC WILL NOT BE RESPONSIBLE FOR ANY DAMAGES, INCLUDING LOST PROFITS OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OF THE SOFTWARE EVEN IF MCC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GOVERNMENT RIGHTS
The Software and related documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to the provisions set forth in DFARS 252.227-7013 (c)(1)(ii) or 48 CFR 52.227-19 (c) (1) and (2), as applicable.
APPLICABLE LAW
Except to the extent governed by the Copyright laws of the United States, this Agreement is governed by the laws of the State of Texas.
